The European Ombudswoman has opened a new inquiry into European Commission President Ursula von der Leyen’s text messages, a letter sent to the EU executive on Friday shows.

Ombudswoman Teresa Anjinho is examining whether the EU executive made mistakes when deciding not to share data with journalists: Follow the Money had asked to see text messages von der Leyen exchanged with leaders – including outgoing UK Prime Minister Keir Starmer and Ukrainian President Volodymyr Zelensky – in a secretive group chat earlier this year.

The Commission denied the request, arguing that sharing them “would undermine the international relations of the EU (and its Member States) vis-à-vis third countries”.

Following this refusal, Follow the Money complained to the Ombudswoman.

The group chat, first reported about in January by Politico, is a channel for European leaders to discuss how to contain the influence of US President Donald Trump.

The loose coalition of leaders, known as “Washington Group”, includes Germany’s Chancellor Friedrich Merz, France’s Emmanuel Macron and Italian Prime Minister Giorgia Meloni.

“I have decided to open an inquiry into the Commission’s handling of the complainant’s request under the EU legislation on public access to documents,” Anjinho said in the letter seen by FTM.

The Ombudswoman sent the Commission a request for a meeting to discuss Follow the Money’s complaint by mid-July. The investigation is likely to take several months.

Last year, the EU’s second highest court found the Commission mishandled a request by The New York Times for a pandemic-era exchange between the Commission chief and Pfizer CEO Albert Bourla over a billion-euro vaccine deal.

And earlier this month, following a monthslong inquiry, Anjinho criticised the Commission for auto-deleting a text message that Macron had sent to von der Leyen about a trade deal with the South American Mercosur bloc.

The Commission had argued that, as the message merely echoed public comments by the French government, it wasn’t kept. Following a complaint by FTM, Anjinho said that deleting it was unlawful.

The EU executive should make sure to preserve crucial information, including texts, and strengthen its internal procedures to make sure this happens, she said.
