His name is Atif Dudakovic, he is 68 years old, but despite having been one of the protagonists of the bloody war in Bosnia, wanted by NATO and the American counter-espionage of the CIA to stop Russian interference in the Balkans, he is unknown to most despite having been arrested and accused for war crimes.

The reason is simple, he was general commander of the 5th Army Corps of the Army of the Republic of Bosnia and Herzegovina (ARBiH) and despite being accused of the massacre of at least 300 civilians in the villages he attacked with his brigade of extremist jihadists shouting of “Allahu al-akbar” (Allah is great) as demonstrated by a shocking video published by Gospa News on Rumble, he became a senior officer in the service of NATO in harmony with that strategy which allowed the birth of a “Caliphate of Europe ” as narrated by a deputy commissioner of the Italian State Police and Interpol official in one of his books.

This is why, unlike  Serbian politicians such as the former president of Yugoslavia and Serbia, Slobodan Milosevic  found dead in prison in The Hague on the morning of March 11, 2006, where he was locked up for his international crimes despite never having held a Kalashnikov, Dudakovic received triple preferential treatment despite his hands being stained with innocent blood.

ONLY 3 DAYS IN PRISON FOR WAR CRIMES

He was arrested in April 2018 but freed a few days later:

FROM THE JIHADIST BRIGADE TO THE NATO TASK-FORCE

Atif Dudaković, born on 2 December 1953 in the village of Orahova, near Bosanska Gradiška, is a former general of the Bosnian army. He served in the Yugoslav People’s Army (JNA) and taught at an artillery school in Zadar and at a military academy in Belgrade. During the Bosnian War, Dudakovic commanded the enclave of Bihac, surrounded and besieged from 1991 to 1995, as head of the 5th Army Corps.

After the war he became General Commander of the Army of the Federation of Bosnia and Herzegovina and thanks to this role he took an active part in NATO’s SFOR.

The Stabilisation Force (SFOR) was a multinational NATO force deployed in Bosnia and Herzegovina and tasked with defending the Dayton Agreements. The SFOR contingent, which had its headquarters in Sarajevo, operated over a period of approximately eight years with two missions called respectively: “Operation Joint Guard” (21 December 1996 – 19 June 1998) and “Operation Joint Forge” (24 April 1998 – 1 December 2004).

REQUEST FOR ARREST FOR THREATS TO WITNESSES IN THE TRIAL

Dudaković, as former commander of the V Army Corps, was accused of crimes

The Prosecutor’s Office of Bosnia and Herzegovina claims that the purpose of the interdictory measure imposed on Dudaković by the Court of Bosnia and Herzegovina and the proposed precautionary detention measure are invalidated.

As evidence, the prosecution presented a video of Dudaković’s speech, which was played at the hearing. Dudaković’s lawyer, Asim Crnalić, said after playing the video that Bosnia and Herzegovina’s prosecutor wants to humiliate his client.

“I do not dispute the restriction that the Court imposed on Dudaković. (…) The question here is whether Dudaković said something that constituted a threat to the witnesses and whether he spoke in any way about the factual allegations of the proceedings. (.. .) This was a speech about the war, about the death camps, about the lessons, about Žepa, Foča, Prijedor. This can be mentioned,” Crnalic said.

The defense lawyer added that there are no elements in the speech that match the factual assertions of the Prosecutor’s Office in the proposed custodial measure, and that no court in Europe can completely ban freedom of speech.

CAPTURE ORDER REJECTED BY THE COURT

At the hearing held on 26 April this year, the Prosecutor’s Office of Bosnia and Herzegovina requested a precautionary custody order against Dudaković, accused of war crimes, due to the content of a public speech that the former General of The Army of Bosnia and Herzegovina held in mid-April 2023 in Sarajevo.

“The Court of Bosnia and Herzegovina has issued a decision rejecting as unfounded the proposal of the Prosecutor’s Office of Bosnia and Herzegovina dated 24 April 2023 to cancel the imposed interdictory measures and order the custody of the accused Atif Dudaković,” states the statement of the Court of Bosnia and Herzegovina. .

According to the announcement, Dudaković is subject to a ban on leaving his place of residence, a travel ban and a ban on meeting certain people.

“According to the Court’s assessment, the manner and character of the defendant’s speech, without indicating clear and direct facts in the proposed indictment, which would unequivocally indicate that the defendant is talking about the criminal case conducted against him or that the accused came into contact with the witnesses, indicates that the prosecution did not present evidence on the basis of which it would be possible, with a sufficient degree of certainty, to establish that the accused indirectly influenced the witnesses and thus called into question the integrity of the ongoing criminal proceedings conducted against him,” says the Court of Bosnia and Herzegovina.

As stated by the prosecution at the hearing, Dudaković violated the ban on meeting and contacting other people, i.e. communication by paper and electronic means of communication, as well as the ban on speaking in public.

THE TESTIMONY ON CHURCHES REDUCED INTO PUBLIC TOILETS

Rajko Jević, who was the bishop of Bihać-Petrovac in 1995 and is now metropolitan of Dabro-Bosnia, said that on November 7, 1996 he visited religious buildings in a large number of settlements with KFOR.

“When I arrived in Bosanski Petrovac, there was a Congregational church there… At that time it had been converted into a public toilet,” Jevic said.

Prosecutor Vedrana Mijović asked him questions about churches and parish houses in numerous villages in the area of four municipalities, and the witness answered what damage there was. According to him, some were set on fire in whole or in part, some suffered minor injuries, and some had building materials taken from them, while some were not significantly damaged.

Jević said that out of 40 buildings, they renovated all but one church. You noted that in two villages, Bosnian nationals had rebuilt churches.

When asked by defense lawyer Ifet Feraget, the witness said he had no information on the suffering of the Bosniaks. He confirmed that there had been air force actions in 1995 and denied that church representatives had made emigration lists. He said that during his visit to the church he did not see any demolished mosque.

At the request of the defense, a witness statement from 1994 was released in which he talked about Islamic fundamentalists in the Fifth Corps and the liberation of Bihać, and Jević explained what he meant by this. To questions from prosecutor Marijana Čobović, he explained that he made that statement after actions in which Serbian civilians were killed in the Bihać region.

THE FATHER KILLED AND THROWN INTO THE COMMON GRAVE

Prosecutor Vedrana Mijović read the testimony of Stanka Dronjak, who stated that the Serbian population left Petrovac on September 14 during the Fifth Corps action and shelling.

The witness said his father Mile (1936) said he would join them when he left town. “That’s when I lost contact with him,” Dronjak said.

According to his knowledge, the father was in the apartment when the city was occupied, and was taken out of the building and killed. He added that he had heard from some of his fellow citizens that some people from Buži did it together with a certain Damir Jakupović.

Dronjak said his father was exhumed from a mass grave in Petrovac.

In the hearing on June 12, however, others reported on the massacre. The witness from the prosecutor’s office of Bosnia and Herzegovina said he discovered that his father and brother had been found dead in September 1995 next to the house in the village of Oraško Brdo in the municipality of Bosanski Petrovac.

Mile Ćulibrk said he last saw his father Milan and his brother Duško, who was disabled, around September 1, 1995. “Unfortunately, they died on the doorstep,” the witness said.

He said that after about two months he received a message from his son-in-law Enver Memagić, who said that he had been in Oraški Brdo where he found his father and brother dead, about 15 meters from the house, and he buried there.

Ćulibrk said that the remains of her father and brother were found in 2013. She added that houses were set on fire in the village and that her relatives Mirko and Boro Ćulibrk were also killed.

When questioned by the Council about who set fire to the houses on Oraški Brdo, the witness stated that she assumed it was the V Army Corps because, as she stated, “there was no one else”.

THE RETRACTION OF AN IMPORTANT WITNESS

The cross-examination of prosecution witness Selver Vojić was scheduled for May 8, but the lawyers of the 14 defendants canceled it.

Vojić, testifying at the invitation of the Bosnia and Herzegovina prosecutor’s office on April 10, said that Simo Tuševljak suggested to him what he should say, that inspectors from the State Investigation and Protection Agency (SIPA) presented it to him and who helped him financially on several occasions, as well as being a member of SIPA for a certain period.

Prosecutor Marijana Čobović submitted to the Judicial Council letters from the police agencies SIPA, the Ministry of Internal Affairs of Republika Srpska, the Federal Police Administration and the Intelligence and Security Agency, stating that Selver Vojić was not their partner.

“The witness gave a statement in 2009. We want to prove that he was telling the truth at that time and that he changed his testimony at the main trial,” prosecutor Čobović said, adding that he would then question the SIPA inspectors mentioned by the witness in the classroom.

Although the Judicial Council ordered the State Prosecutor’s Office to present all evidence to the defense within ten days, the CDs have not yet been handed over and the Bosnia and Herzegovina Prosecutor’s Office said that the materials are being scanned and which will be delivered by the end of June.

Prosecutor Marijana Čobović suggested that, together with the written recording of the witness’s hearing at the SIPA premises on 14 May 2009, the audio recording of that hearing be attached, which the defense objected to.

DUDAKOVIC SAYS HE IS SICK, STOP THE TRIAL

The trial against the former commander of the Fifth Corps of the Army of Bosnia and Herzegovina (ABiH) Atif Dudaković and 14 other defendants will not continue in the coming months, pending further medical investigations.

Due to illness, Dudaković and Hasan Ružnić did not attend the hearing. Judge Željka Marenić cited a number of reasons why this trial was stalled for about two and a half years: Dudaković’s illness, as well as the sick leave of other participants in the proceedings, the failure to hold the trial during the pandemic, and the change of Council members.

“I think the time has come for the parties and defense lawyers to declare the further continuation of the proceedings,” Marenić said.

He listed a series of findings that were presented on Dudaković’s state of health, specifying that the neuropsychiatrist expert, for his part, stated that the accused is able to follow the procedure, while the internist did not express a final judgement. The judge said the internist suggested the tests be done within four months because of complications from the medical condition.

The prosecution and all the defense have agreed to await further investigations. The public prosecutor, Marijana Čobović, said she opposed the possible separation of the proceedings at this stage.
