The International Court of Justice (ICJ) in The Hague has released a statement in which it confirms that it has received from South Africa an Application for provisional measures against Israel to interrupt its genocide in Palestine.
«South Africa today filed an application instituting proceedings against Israel before the International Court of Justice (ICJ), the principal judicial organ of the United Nations, concerning alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) in relation to Palestinians in the Gaza Strip» we read in the ICJ statement released yesterday.
The International Court of Justice (ICJ), also called World Court, is the principal judicial organ of the United Nations. But other judicial actions are pending.

Several Complaints lodged at the International Criminal Court
«In the ongoing conflict between Israel and Hamas, international justice is being summoned, with several complaints lodged at the International Criminal Court (ICC) following the 7 October attack by Hamas in Israel and the response by Israeli Defense Forces in Gaza» the UN Regional Information Centre for Western Europe further recalls.
ICC Prosecutor Karim Ahman Khan, who visited the war zones a month ago without taking any decisions, has all the legal tools in his hands to issue an arrest warrant of the leader of the Zionist Tel Aviv regime who ordered the Israel Defense Forces to shoot against hospitals and churches, carrying out a massacre of civilians including at least 8 thousand children, thousands of women and defenseless elderly people.

South Africa request for Provisional Measures has Priority over All other Cases
Now South Africa addressed also the International Court of Justice as has already been done in the past also by Palestine on the disputed management of East Jerusalem by Israel and the relocation of the American embassy ordered by former president Donald Trump.
«According to the Application, “acts and omissions by Israel . . . are genocidal in character, as they are committed with the requisite specific intent . . . to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group” and that “the conduct of Israel — through its State organs, State agents, and other persons and entities acting on its instructions or under its direction, control or influence — in relation to Palestinians in Gaza, is in violation of its obligations under the Genocide Convention”».
The Applicant further states that “Israel, since 7 October 2023 in particular, has failed to prevent genocide and has failed to prosecute the direct and public incitement to genocide” and that “Israel has engaged in, is engaging in and risks further engaging in genocidal acts against the Palestinian people in Gaza”.
South Africa seeks to found the Court’s jurisdiction on Article 36, paragraph 1, of the Statute of the Court and on Article IX of the Genocide Convention, to which both South Africa and Israel are parties.
«The Application also contains a Request for the indication of provisional measures, pursuant to Article 41 of the Statute of the Court and Articles 73, 74 and 75 of the Rules of Court. The Applicant requests the Court to indicate provisional measures in order to “protect against further, severe and irreparable harm to the rights of the Palestinian people under the Genocide Convention” and “to ensure Israel’s compliance with its obligations under the Genocide Convention not to engage in genocide, and to prevent and to punish genocide”».
Pursuant to Article 74 of the Rules of Court, “[a] request for the indication of provisional measures shall have priority over all other cases”. The main request is to immediately interrupt any military operation.
«Other public hearings have also been set for February 2024 by the ICJ on the “legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territory, including East Jerusalem,” within the framework of a request for an advisory opinion prior to the current conflict, emanating from the United Nations General Assembly» pointed out UN Regional Information Centre for Western Europe.

The International Court does not enjoy a full separation of powers, with permanent members of the Security Council being able to veto enforcement of cases, even those to which they consented to be bound. The Other Complaints filed before ICC
According to UN Regional Information Centre for Western Europe, the complaints filed before International Courts so far include:
- Reporters Without Borders (RSF) submitted a complaint on 31 October to the ICC for “war crimes committed against journalists in Israel and Palestine,” citing the death of nine journalists, an Israeli killed during the attack on his kibbutz on 7 October, and eight Palestinians. The document mentions the destruction of 50 premises belonging to press organizations in Gaza. This is the third complaint since 2018 filed by RSF with the ICC following the death of journalists in Gaza. The most recent complaint, in 2022, was filed in conjunction with one by the Qatari channel Al Jazeera regarding the shooting death of its Palestinian journalist Shirin Abu Akleh in the West Bank.

- Nine Israeli families impacted by the Hamas attack on 7 October filed a complaint on 2 November at the ICC for “war crime, crimes against humanity, and genocide,” with their lawyer requesting the ICC consider issuing international arrest warrants against Hamas leaders.
- A third complaint for “genocide” in Gaza was filed on 8 November by a collective composed of a hundred jurists from several countries, including members of the bar in Algeria, private individuals, and representatives of associations, represented by the French lawyer Gilles Devers.
- Three Palestinian human rights organizations (Al-Haq, Al Mezan, and the Palestinian Centre for Human Rights) filed a complaint on 8 November with the ICC for “war crimes,” “apartheid,” “genocide,” and “incitement to genocide,” requesting the issuance of arrest warrants against three Israeli leaders. The complaint cites “bombings on a densely populated area, the siege of Gaza, the forced displacement of the population of Gaza, the use of toxic gas, and the deprivation of necessities such as food, water, gasoline, and electricity.”

In the Application page in the ICJ official website we can read further the differents accuses the multiple and detailed accusations supported by South Africa:
«In accordance with Articles 36 (1) and 40 of the Statute of the Court and Article 38 of the Rules of Court, I have the honour to submit this Application instituting proceedings in the name of the Republic of South Africa (“South Africa”) against the State of Israel (“Israel”). Pursuant to Article 41 of the Statute, the Application includes a request that the Court indicate provisional measures to protect the rights invoked herein from imminent and irreparable loss».
South Africa refers Israel to International Criminal Court for Genocide in Gaza
According the document of lawsuit, South Africa is also aware that acts of genocide inevitably form part of a continuum — as Raphaël Lemkin who coined the term ‘genocide’ himself recognised.
«For this reason it is important to place the acts of genocide in the broader context of Israel’s conduct towards Palestinians during its 75-year-long apartheid, its 56-year- long belligerent occupation of Palestinian territory and its 16-year-long blockade of Gaza, including the serious and ongoing violations of international law associated therewith, including grave breaches of the Fourth Geneva Convention, and other war crimes and crimes against humanity».
With these words South Africa reiterates the concepts already expressed by the UN Secretary General Antonio Guterres which were objects of criticism by the Israeli diplomatic representative in the General Assembly who made the sensational, out-of-place gesture of pinning the yellow star that the Nazis placed on his chest. about Jews in concentration camps.
«However, when referring in this Application to acts and omissions by Israel which are capable of amounting to other violations of international law, South Africa’s case is that those acts and omissions are genocidal in character, as they are committed with the requisite specific intent (dolus specialis) to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group» add the South Africa request.
The Application remember the vain efforts made by the UN to stop the massacre:
«United Nations experts have also repeatedly sounded “the alarm” for over 10 weeks that “[c]onsidering statements made by Israeli political leaders and their allies, accompanied by military action in Gaza and escalation of arrests and killing in the West Bank” there is a “risk of genocide against the Palestinian people”. United Nations experts have also expressed their “profound … concern” about “the failure of the international system to mobilise to prevent genocide” against Palestinians, and have called on the “international community” to “do everything it can to immediately end the risk of genocide against the Palestinian people”».
Then the South Africa complaint analyzed in details the facts:
«Repeated statements by Israeli State representatives, including at the highest levels, by the Israeli President, Prime Minister, and Minister of Defence express genocidal intent. That intent is also properly to be inferred from the nature and conduct of Israel’s military operation in Gaza, having regard inter alia to Israel’s failure to provide or ensure essential food, water, medicine, fuel, shelter and other humanitarian assistance for the besieged and blockaded Palestinian people, which has pushed them to the brink of famine».
The Application highlights the terrible death toll:
«It is also clear from the nature, scope and extent of Israel’s military attacks on Gaza, which have involved the sustained bombardment over more than 11 weeks of one of the most densely populated places in the world, forcing the evacuation of 1.9 million people or 85% of the population of Gaza from their homes and herding them into ever smaller areas, without adequate shelter, in which they continue to be attacked, killed and harmed. Israel has now killed in excess of 21,110 named Palestinians, including over 7,729 children — with over 7,780 others missing, presumed dead under the rubble — and has injured over 55,243 other Palestinians, causing them severe bodily and mental harm».
21 States denounced the Devastating Bombing in Gaza
The paper pointed out also the devastating bombing:
«Israel has also laid waste to vast areas of Gaza, including entire neighbourhoods, and has damaged or destroyed in excess of 355,000 Palestinian homes, alongside extensive tracts of agricultural land, bakeries, schools, universities, businesses, places of worship, cemeteries, cultural and archaeological sites, municipal and court buildings, and critical infrastructure, including water and sanitation facilities and electricity networks, while pursuing a relentless assault on the Palestinian medical and healthcare system. Israel has reduced and is continuing to reduce Gaza to rubble, killing, harming and destroying its people, and creating conditions of life calculated to bring about their physical destruction as a group».
In light of the extraordinary urgency of the situation, South Africa seeks an expedited hearing for its request for the indication of provisional measures among which that “The State of Israel shall immediately suspend its military operations in and against Gaza”.
South Africa and other States Parties to the Genocide Convention have, in particular, made clear that Israel’s actions in Gaza constitute genocide against the Palestinian people.
By way of example, the Presidents of Algeria, Bolivia, Brazil, Colombia, Cuba, Iran, Türkiye, and Venezuela have all described Israel’s actions as a genocide, as has the Palestinian President. State officials and representatives from Bangladesh, Egypt, Honduras, Iraq, Jordan, Libya, Malaysia, Namibia, Pakistan, Syria, and Tunisia, have also referred to genocide or the risk thereof in Gaza.
